FAQ on revised Swiss Federal Act on Data Protection now available in English

The Federal Office of Justice has recently released an English version of its frequently asked questions (‘FAQ’) on data protection. The FAQ provides information about the updated Federal Act on Data Protection (‘the revised FADP’) and notes that the Federal Council has put the revised FADP, along with the corresponding implementation provisions, into effect as of September 1, 2023.

The FAQ also addresses the evaluation of international developments in data protection. It highlights that Switzerland has held an EU adequacy decision since 2000, which acknowledges a comparable level of data protection. Furthermore, the revised FADP allows for the Swiss level of protection to be aligned more closely with EU standards.
