New Czech Metodology on CCTV systems

The Czech Office for Personal Data Protection has launched a public consultation on the material „Methodology for the design and operation of CCTV systems in terms of processing and protection of personal data“. The aim of the draft methodology on CCTV systems is to ensure better orientation of data controllers and processors of personal data, as well as suppliers of CCTV systems, in the obligations concerning the design, establishment and operation of CCTV systems.  

The main purpose of the methodology submitted for public consultation is to ensure clarity of the obligations under the General Data Protection Regulation (GDPR) and the EDPB Guidance No 3/2019 on the processing of personal data through video technology. 

The Methodology covers CCTV systems (including photo traps) with recording as well as online CCTV systems without recording ability which are regulated by GDPR. According the Czech DPA the Methodology is not a legally binding document and therefore it remains the duty of data controllers to always comply with the General Data Protection Regulation (GDPR) and the EDPB Guideline No 3/2019. However, the correct application of the Methodology should ensure compliance with both the General Regulation (GDPR) and the aforementioned EDPB Guideline. 

As the Methodology is not legally binding, the controller may use other methods or procedures to ensure compliance with the obligations set out in the GDPR. It is also possible to use only some parts of the Methodology and address the rest of the requirements differently.
