The conference “Controller as hostage of the processor”

On the third anniversary of the General Data Protection Regulation (GDPR), the Czech Data Protection Association organized a conference entitled “Controller as Hostage of the Processor”. The conference, which was attended by 150 people, addressed the relatively widespread phenomenon where personal data controllers, who are according to the GDPR fully responsible for processing of personal data, have to accept the contractual conditions of their suppliers – processors that do not guarantee sufficient protection of individuals’ rights or are otherwise incompatible with GDPR. Issues related to the Data Protection Officers were also discussed, in particular the conflicts of interest in the case where the DPO performs other services for the same controller.   The conference was opened by the President of the Czech Senate, Mr. Miloš Vystrčil. The view of the legislator from the lower house of the Czech Parliament was presented by Mr. Ondřej Profant, who emphasized the need for a unified European solution to the issues of personal data protection. Further speakers were member of the European Parliament Mr. Ondřej Kovařík, one of the shadow correspondents on the Digital Markets Act, Mr. Josef Prokeš, Vice-Chairman of the Data Protection Office, and Mr. Dan Jiránek, on behalf of the Union of Towns and Municipalities of the Czech Republic.   Representatives of Czech and Slovak associations dealing with personal data protection also presented their contributions at the conference. Speakers from the Czech Data Protection Association were Mr. Vladan Rámiš and Mr. František Nonnemann, members of the association’s committee and Mrs. Lenka Grygarová and Mr. Radek Kubíček. Mrs. Tatiana Valentová introduced the Slovak practice.
